We, the DiaCCon GmbH (hereinafter referred to as DiaCCon) take the protection of your personal data seriously and strictly adhere to the rules of the data protection laws of the Federal Republic of Germany (BDSG), the Telemedia Act (TMG) and the European General Data Protection Regulation (EU-DSGVO)., As far as reference is made to the GDPR in this privacy policy, it is clarified that this will only apply from 25 May 2018. Before, the legal basis is the BDSG.

This privacy statement covers the use of DiaCCon's digital offerings via PCs, smartphones, tablets and all other internet-enabled mobile devices.

2. Purpose of the processing of personal data

2.1 Data processing for the provision of contractual services

We process your data in order to handle the contractual relationships between you and us and to provide you with tailor-made contract offers. The collection of the data is carried out in particular for the conclusion of a contract regarding one of our products.
On our website we provide you with our contact details. You can always contact us via this data. You decide on a voluntary basis, if and what data you want to give us.

On our website we use various online forms for the purpose of informing about our services. The forms are tailored to the needs of the users of our site. For all forms, we only obligatorily collect personal data which is absolutely necessary for the processing of the contractual conditions or for your information inquiry. This information is provided with an asterisk. The collection of data that is not strictly necessary but of which we are interested is optional. In this case, you decide on a voluntary basis, whether and what data you want to give us.

For a commission we need your correct name, address, and payment data. We will ask for your e-mail address and telephone number so that we can confirm the order receipt and communicate with you in case of problems regarding the service requested by you.
The basis for data processing is Art. 6 para. 1 lit. b DSGVO, which allows the processing of data to fulfill a contract or pre-contractual measures.

2.2 Data processing for communication with you

In addition to the contract data, we process your provided communication data (address, telephone number, e-mail address) in order to contact you. Personal data that you provide to us by e-mail will be processed only for correspondence with you or for the purpose for which you provided us with the data.
The basis for data processing is Art. 6 para. 1 lit. b DSGVO, which allows the processing of data to fulfill a contract or pre-contractual measures.

2.3 Data processing for advertising purposes

In the case of the use of your data for advertising purposes for our products and for other products of our cooperation partners, we obtain your consent.
Data processing then takes place on the basis of your consent (Article 6 (1) (a) DSGVO). You can revoke your consent at any time. The legality of the already completed data processing operations remains unaffected by the revocation.

2.4 Data processing to fulfill legal obligations

In addition, we process your data to fulfill legal obligations (for example, regulatory requirements, commercial and tax-related retention and proof obligations).

The basis for data processing is Art. 6 para. 1 lit. c DSGVO, which allows processing to fulfill a legal obligation.

2.5 Use of data for purposes of fraud prevention

The data you provide in the context of an order can be used by us to check whether an atypical order process exists. In principle, we have a legitimate interest in undertaking such a review. The processing of the data takes place on the legal basis in Art. 6 para. 1 lit. f DSGVO.

2.6 Transmission of data on outstanding claims to collection service providers

If you do not settle outstanding invoices / installments despite a repeated reminder, we may collect the data (name, address, mailing address, details of the company and, if applicable, contract and claim data) required for the collection of a debt collection service for the purpose of selling the outstanding claims also for the purpose of debt collection and collection processing. When the outstanding claims are sold, the latter then becomes the claimant and asserts the claim in his own name.

2.7 Cookies

2.9 Log files

Every time you access our websites, usage data is transmitted through the respective Internet browser and saved in log files, the so-called server log files. The datasets stored in this case contain the following data: date and time of the retrieval, name of the visited page, IP address, referrer URL (origin URL from which you came to the web pages), the amount of data transmitted, and product and Version information of the used browser. 4. Duration of data storage

As a matter of principle, we will delete your data as soon as it is no longer necessary for the above purposes, unless temporary storage is still necessary. The storage periods are thereafter up to ten full years.
